This Privacy Policy describes how NegoNow ("NegoNow," "Company," "we," "us," or "our") collects, uses, stores, discloses, and protects personal information when you access or use the NegoNow mobile application, website, and all related services (collectively, the "Service"). Please read this Privacy Policy carefully. By using the Service, you acknowledge that you have read and understood this policy.
If you do not agree with the practices described in this Privacy Policy, you must discontinue use of the Service.
1. Information We Collect
1.1 Information You Provide Directly
We collect information you provide when creating an account or using the Service, including:
- Account Information: Full name, email address, and password.
- Profile Data: Optional professional details such as occupation, experience level, and stated negotiation goals.
- Payment Information: Billing information is processed exclusively through Apple App Store or Google Play Store. NegoNow does not collect, store, or process your payment card details.
1.2 Information Generated Through Your Use of the Service
We collect data generated through your interactions with the Service, including:
- Practice Session Data: Chat transcripts, AI-generated feedback, session scores, and performance metrics from your negotiation practice sessions.
- Voice Recordings: If you elect to use voice practice mode, audio recordings are processed in real time for speech-to-text conversion and analytics (including pacing, filler word detection, and speaking duration). Voice recordings are processed in real time and are not permanently retained on our servers unless you expressly opt in to session recording storage.
- Learning Progress: Lesson completions, assessment results, journey progress, achievements, and activity streaks.
1.3 Automatically Collected Information
When you access the Service, we automatically collect certain technical and usage information, including:
- Device Information: Device type, operating system version, unique device identifiers, and application version.
- Usage Data: Screens and features accessed, session duration, and user interaction patterns.
- Log Data: IP address, access timestamps, and error logs used for security monitoring and debugging.
2. How We Use Your Information
We use the personal information we collect for the following purposes:
- Service Delivery: To operate and deliver AI-powered negotiation practice, personalized feedback, and progress tracking.
- Service Improvement: To analyze usage patterns, identify errors, develop new features, and enhance the user experience.
- Personalization: To adapt content recommendations, scenario difficulty, and AI coaching based on your skill level and progress.
- Communications: To send account-related notifications and security alerts, and, with your prior consent, to send product updates and educational content.
- Legal and Security: To detect, prevent, investigate, and respond to fraud, abuse, unauthorized access, and other security incidents.
- Legal Compliance: To comply with applicable laws, regulations, and enforceable governmental requests.
3. Third-Party Artificial Intelligence Services
3.1 Service Provider
NegoNow uses Google LLC's AI platform services (Google Cloud Vertex AI / Google AI API) as its primary third-party AI processing provider to power negotiation simulations and feedback generation.
3.2 Data Transmitted
When you engage in a negotiation practice session, we transmit your chat message inputs (text) and session context parameters to Google's AI service. We do not transmit your real name, email address, or other direct personal identifiers to the AI service provider.
3.3 Purpose
Data is shared with the AI service provider solely to generate realistic, real-time AI responses and coaching feedback for your practice sessions.
3.4 Your Consent
Before any data is transmitted to Google's AI service, the application will present you with an explicit in-app consent prompt. You may withdraw your consent at any time through the application settings; however, withdrawal of consent will disable AI-powered features.
3.5 Data Protection and Training Restrictions
We utilize Google's enterprise-grade API under terms that prohibit Google from using your data to train or improve its general-purpose AI models. Google's data protection standards applicable to our agreement meet or exceed our own security standards.
4. Data Retention
We retain your personal information for as long as your account is active or as otherwise necessary to provide the Service. Our specific retention periods are as follows:
- Account Data: Retained for the duration of your active account and deleted within thirty (30) days following account deletion.
- Practice Session Data: Retained while your account is active to support progress tracking and session history. Permanently deleted within thirty (30) days of account deletion.
- Voice Recordings (Real-Time Mode): Not permanently retained on our servers unless you have opted in to session recording storage.
- Anonymized Analytics: Aggregated, de-identified usage data may be retained indefinitely for service improvement and business analytics.
You may request deletion of your account and associated data at any time through the in-app account settings or by contacting us at support@negonow.com.
5. Cookies and Local Storage
5.1 Website Cookies
Our website may use cookies and similar tracking technologies (such as web beacons and pixel tags) to analyze website traffic, improve user experience, and support security functions. You may control or disable cookies through your browser settings; however, some features of the website may not function correctly if cookies are disabled.
5.2 Mobile Application Local Storage
The mobile application uses on-device local storage (such as SharedPreferences on Android and NSUserDefaults on iOS) to save your preferences, settings, and progress data locally. Data stored locally on your device is not transmitted to our servers except as necessary to sync your account or provide the Service.
6. Data Security
We implement commercially reasonable, industry-standard technical and organizational security measures designed to protect your personal information against unauthorized access, disclosure, alteration, or destruction. Our security measures include, but are not limited to:
- Encryption of all data in transit using Transport Layer Security (TLS/HTTPS);
- Secure storage of account credentials using industry-standard hashing and salting techniques;
- Role-based access controls to limit employee access to personal information;
- Regular security reviews, vulnerability assessments, and incident response planning.
While we are committed to protecting your information, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security. In the event of a data breach that poses a risk to your rights and freedoms, we will notify you within seventy-two (72) hours of becoming aware of the breach, via the email address associated with your account and/or through an in-app notification, in accordance with applicable law.
7. Children's Privacy
The Service is not intended for, and we do not knowingly collect personal information from, children under the age of thirteen (13). If we become aware that we have inadvertently collected personal information from a child under 13, we will take prompt steps to delete such information from our systems.
If you believe that a child under the age of 13 has provided personal information to us without verifiable parental consent, please contact us immediately at support@negonow.com.
8. Your Privacy Rights
Depending on your jurisdiction, you may have the following rights with respect to your personal information:
- Right of Access: To request a copy of the personal information we hold about you.
- Right of Rectification: To request correction of inaccurate or incomplete personal information.
- Right of Erasure: To request deletion of your personal information, subject to our legal obligations.
- Right to Data Portability: To receive your personal information in a structured, machine-readable format.
- Right to Withdraw Consent: Where processing is based on your consent, to withdraw that consent at any time without affecting the lawfulness of prior processing.
- Right to Opt-Out of Marketing: To unsubscribe from marketing communications at any time using the unsubscribe link in our emails or by contacting us directly.
To exercise any of the above rights, please submit a request to support@negonow.com. We will respond to your request within thirty (30) days of receipt. We may require verification of your identity before processing your request.
8.1 European Economic Area and United Kingdom (GDPR / UK GDPR)
If you are located in the European Economic Area or the United Kingdom, our legal bases for processing your personal information are:
- Contract Performance: Processing necessary to provide the Service you have requested.
- Consent: Processing for which you have provided explicit consent (e.g., marketing communications; AI service data transmission).
- Legitimate Interests: Processing necessary for our legitimate business interests (e.g., service improvement, security), where such interests are not overridden by your rights and freedoms.
- Legal Obligation: Processing required to comply with applicable law.
You have the right to lodge a complaint with your local data protection supervisory authority if you believe your rights under applicable data protection law have been violated.

8.2 California Residents (CCPA / CPRA)
If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):
- Right to Know: To request disclosure of the categories and specific pieces of personal information we have collected about you, and how we use and share it.
- Right to Delete: To request deletion of personal information we have collected from you, subject to certain exceptions.
- Right to Correct: To request correction of inaccurate personal information.
- Right to Opt-Out of Sale or Sharing: NegoNow does not sell or share your personal information for cross-context behavioral advertising as defined under the CCPA/CPRA.
- Right to Non-Discrimination: You will not receive discriminatory treatment for exercising your privacy rights.

9. International Data Transfers
NegoNow is operated from the United States. If you access the Service from outside the United States, your personal information may be transferred to, stored, and processed in the United States or other countries, which may have data protection laws that differ from those of your jurisdiction.
Where required by applicable law (including the GDPR), we implement appropriate safeguards for international data transfers, such as standard contractual clauses approved by the European Commission or the UK Information Commissioner's Office, or other lawful transfer mechanisms.

For transparency and in connection with Apple's App Privacy requirements, the following summarizes the categories of data NegoNow collects and how they are used:

11. Changes to This Privacy Policy

For material changes, we will notify you at least thirty (30) days in advance by posting the updated policy within the app, on our website, or by sending an email notification to your registered address.
The "Last Updated" date at the top of this Privacy Policy indicates when the most recent changes were made. Your continued use of the Service following notice of changes constitutes your acceptance of the updated Privacy Policy.
